Terms of Service
Last updated: 2026-04-24
These terms govern use of the Contango platform, including the SMS program operated on behalf of participating grain elevators. The Acceptable Use Policy below sets out what may and may not be sent through that program.
SMS Program — Acceptable Use Policy
Contango operates the SMS program as the first-party sender of record. Participating grain elevator customers initiate messages through the Contango platform to farmers who have opted in to receive SMS from that specific elevator.
Permitted content
Messages sent through the Contango SMS program may cover any of the following:
- Grain bid prices and price-target alerts for the crops the farmer produces
- Short market commentary (basis trends, WASDE report impacts, tariff news, weather and harvest-window updates)
- Enrollment and promotional messages relating to the elevator's own programs — for example, NGMO grower agreements, free delayed-pricing offers, limited-time contract incentives
- Operational coordination — bin space availability, delivery scheduling, trucking windows
- Trade and contract notifications — settlement posts, basis-contract roll reminders, Daily Average contract updates
- Invitations to the elevator's in-person events, such as grower meetings
The farmer is informed of this full content scope in the opt-in consent script and on the public SMS Program page. Their consent applies to the full scope.
Prohibited content
The following content categories are prohibited and will result in immediate program suspension for the originating elevator:
- SHAFT content: Sex, Hate, Alcohol, Firearms, Tobacco (industry-standard prohibition)
- Third-party promotional content not related to the sending elevator's own business
- Any send to a phone number that does not have a live, per-elevator consent record at the moment of sending
- Any send that breaches a farmer's recorded opt-out state (STOP is a sledgehammer that blocks all subsequent sends from all elevators until the farmer re-opts in somewhere)
- Any send originating from a non-originator account (only trained originators with the messaging permission may initiate sends)
Originator responsibilities during verbal opt-in capture
When an originator captures verbal consent by phone, they must:
- Read the currently-active approved script verbatim, without editorializing or omitting disclosures
- Select the script whose declared content scope matches what they intend to send
- Confirm an unambiguous "yes" from the farmer (not silence, not "sure, whatever", not a conditional)
- Confirm the farmer's phone number before recording the consent
- Not coerce, not pressure, not bundle the SMS opt-in with any other approval
Originators complete a 15-minute training module before they're granted access to the attestation form. The training and the sampling audit (5% of attestations reviewed quarterly by Product + Legal) together enforce script discipline.
Audit and retention
Contango retains all SMS consent records, message send records, and audit log entries indefinitely for regulatory compliance purposes. Data retention details are in the Privacy Policy.
